First on FOX: New law widely bans visa holders who support Hamas or other designated terrorist groups remaining in the US

The Terrorist Tolerance Codification Act, led by R-Texas’ August Pfluger, expands current laws under the Immigration and Nationality Act, prohibiting Hamas, Hezbollah, al-Qaeda, ISIS and Palestinian Ram Jihad entering or remaining in the United States.

“America has no place for foreign enemies and terrorist sympathizers. As our country faces the disturbing rise of anti-Semitic and illegal alien terrorist attacks, there is an increasing increase in parent-child sentiment on university campuses,” Pfluger said in a statement. “We must take action to ensure that our borders are safe from those who want to be harmed to Americans.”

The bill comes after a wave of anti-Semitic attacks in light of Israel’s campaign to attack in Gaza following Hamas’ October 7 attack.

The Trump administration has begun revoking student visas for those engaged in pro-Gaza protests. The State Department paused new student visa interviews later last month and restructured the review process.

The Immigration and Nationality Act prohibits individuals who are already engaged in terrorist activities and are members of designated foreign terrorist organizations or provide material support to such groups. However, much of this is interpreted on a case-by-case basis, and often requires evident thresholds such as proof of direct involvement or evidence of financial or material aid. It is subject to whims specified by management.

The Terrorist Tolerance Codification Act seeks to expand these standards by codifying that mere support or supporters of terrorist groups’ ideology could be the basis for tolerance or deportation.

This could indicate a transition from behavior-based immigration enforcement to speech- or association-based scrutiny. Even those who were not official members of foreign terrorist organizations were able to scrutinize their speeches in support of such groups.
