The Trump administration announced Thursday that the Department of Health and Human Services would ban illegal immigration from accessing taxpayer-funded services, including the popular HeadStart early childhood education program.

The agency announced that it would withdraw its interpretation of the 1996 Personal Responsibility and Labor Opportunity Settlement Act (PRWORA).

“For too long, the government has diverted the taxes of hardworking Americans to encourage illegal immigration,” said HHS Director Robert F. Kennedy Jr.

PRWORA, known as Welfare Reform, was passed during the Clinton administration and granted the state greater autonomy to administer social welfare programs.

The new policy applies the PRWORA plain language definition of “federal public interest,” confirms that programs that serve individuals, households, or families are subject to eligibility restrictions and makes it clear that HHS programs are not formally exempted under the limited exceptions of PRWORA.

Among the programs that illegal immigrants no longer have access to is HeadStart, an early childhood education and nutrition program aimed at low-income families.

A preliminary analysis from HHS estimates that American citizens will receive an additional $374 million annual Head Start service.

“Alongside the HHS, the Children and Families Administration (ACF) is committed to providing and protecting America’s most vulnerable resources,” said Deputy Chief Andrew Graujuan. “The Head Start classification based on the new PRWORA interpretation will ensure that taxpayer-funded benefits are reserved for eligible individuals, making American families the first first.”

Other services currently falling under the “federal public interest” category include grant programs such as workforce programs, mental health and substance abuse.

The new policy will take effect upon publication in the Federal Register and will have a 30-day comment period.
