Immigration Customs Enforcement (ICE) has recently been granted access to Medicaid registration data and supported by officers tasked with serving the Trump administration’s purpose of tracking and deporting illegal immigrants.
Medicaid, which uses taxpayer dollars to provide health insurance to low-income adults and children, has over 71 million subscribers as of March 2025.
According to a report from the Associated Press, information shared with ICE includes the address of the home and ethnicity.
The mediated agreement between the Centers for Medicare and Medicaid Services (CMS) and the Department of Homeland Security (DHS) was signed Monday, according to the report.

The true number of illegal immigrants in Medicaid is unknown, but around 1.4 million people currently taking Medicaid do not meet the citizenship and immigration status requirements for Medicaid registrations, according to documents from the Congressional Budget Office.
DHS Deputy Chief Tricia McLaughlin told the initiative to ensure illegal immigrants do not receive taxpayer-funded health benefits.
“President Trump has consistently committed to protecting Medicaid for eligible beneficiaries,” McLaughlin wrote in a statement. “After Joe Biden floods our country with tens of millions of illegal alien CMS and DHS, we are looking for initiatives to ensure that illegal aliens do not receive Medicaid benefits targeted at law-abiding Americans in order to keep that promise.”

The deal comes weeks after California and 19 other states sued the Trump administration for transferring Medicaid data to DHS.
“The U.S. Department of Health and Human Services (HHS) Centers for Medicare and Medicaid Services (CMS) has handed over the protected health data of individuals from states, including California, Illinois and Washington, to other federal agencies, including the Department of Homeland Security (DHS),,” according to court documents. “The health information of millions of individuals has been transferred without consent and in violation of federal law.”

The lawsuit argues that sensitive national health data can only be used for Congress-approved purposes, accusing the Trump administration of violating federal laws, including the Administrative Procedure Act (APA) and the Health Insurance Portability and Accountability Act (HIPAA).
