The illegal immigrant arrested in January on charges of incest and sexual assault are now under the control of the US Immigration Customs Enforcement (ICE) after being released from the Virginia County Jail.
According to the ice release, the State Department’s diplomatic security team, the Bureau of Alcohol, Tobacco, Firearms and Virginia Police last week arrested Honduras national Marvin Mateo Alberto, who was illegally in the United States.
Hoduran National was the first to enter the United States near Eagle Pass, Texas in October 2005, where he was notified of appearing before an immigration judge.

In April 2006, a Justice Department judge ordered Mateo Alberto to be removed from the United States.
Nevertheless, Mateo Alberto was arrested in January by the Fairfax County Police Department and charged with aggravated sexual assault and incest with a child between the ages of 13 and 17.
However, the release said the county detention center did not respect the ice detainees and released Mateo Alberto 15 days after his arrest.
Fairfax County added that, according to the county’s website, “does not designate “itself” as a sanctuary county as “itself.”
However, the website also states that it is an official policy. “The federal immigration laws for citizens are not enforced and will not be enforced.”

“The federal court has held that enforcement of the Civil Immigration Act is federal liability under the exclusive authority of ice,” the county website reads.
The Fairfax County Sheriff’s Office did not immediately respond to a Fox News digital request for comments.
Mateo-Alberto was eventually arrested by ICE on April 10th and remains under agency control, according to ICE releases.

“Marvin Mateo Alberto is accused of a very frightening and intrusive crime, representing a threat to children in the Virginia community,” Washington, D.C., Field Office Director Russell Hot said.
“We cannot allow Mateo to continue to maintain the potential for potential threats to other children in our neighborhood. ICE Washington, DC will continue to prioritize public safety by arresting and eliminating criminal alien threats from our streets.”
