New York City police arrested Rojas on August 28, 2023. He was later found guilty in Kings County Supreme Court in Brooklyn on September 20, 2024, of forcibly touching the intimate parts of an 11-year-old victim. He was sentenced to 60 days in jail, suspended for six years, and required to register as a sex offender.

A few days later, on January 11, border authorities removed Rojas again after he tried to enter the country using fraudulent documents at another port of entry in Nogales.
New York ICE Field Office Director Kenneth Gennaro said of the arrest, “This criminal has no regard for our laws, as evidenced by his repeated attempts to enter the United States illegally and fraudulently.” It has repeatedly shown that.”
