First on FOX: An illegal transgender foreigner has been charged with child rape in a sanctuary city in New York, according to the Department of Homeland Security.
DHS told Fox News Digital that illegal alien Nicol Alexandra Contreras-Suarez is a Colombian biological man who identified him as a woman and has been charged with raping a minor and a stalker.
According to the agency, Contreras Suarez was arrested by the US Customs and Border Patrol in March 2023 for illegally entering San Isidro, California.
Contreras Suarez was arrested by the Medford Police Department in Massachusetts for armed robbery, prostitution and assault with dangerous weapons. But “Because of the local sanctuary policy,” DHS said, Contreras-Suarez was released again.

Contreras-Suarez is currently facing criminal charges in New York for first-degree rape and stalking of a child under the age of 17. Contreras-Suarez is holding a preliminary criminal hearing in New York City this week, and is expected to hear his case at the New York Supreme Court on September 10th.
The agency said Contreras Suarez’s “terribly preventable crimes show the consequences of the Biden administration’s fishing and release and sanctuary policies.”
Commenting on the arrest, DHS Deputy Chief Tricia McLaughlin lamented, “This creep should not be released to our country.”
Just as Trump’s DHS finds immigrant children, former ice chief torch’s “ruthless” Biden era policy
President Donald Trump (c) will speak with reporters along with Homeland Security Secretary Christa Noem (R) and Florida Governor Ron DeSantis (L) after arriving at Dade Carrier Training and Transition Airport in O’Copy, Florida on July 1, 2025.
“Thanks to the failed sanctuary policy and Biden’s open border agenda, this serial criminal was freed to prey on innocent American children, but that’s now over,” she said.
ICE stayed immigrant detainees against Contreras-Suarez in February. He is currently in custody at Rikers Island Prison in New York until his next court hearing.
This is because US immigration and customs enforcement face fierce criticism of the crackdown on illegal immigration, with executives dealing with an 830% increase in assaults.
The agency says it will not retreat from arresting immigrants illegally in the country, but a new DHS statement says that the majority of those arrested so far have been criminally charged or convicted. Despite allegations by some Democrats that ICE targets innocent immigrant communities, 70% of agency arrests came from illegal aliens convicted or charged with a crime.

DHS called Contreras-Suarez one of the “worst and worst” criminal illegals to arrest during a national sweep so far.
“Ice won’t allow predators like Contreras Suarez to terrorize American citizens,” McLaughlin said.
