The brothers joined the hearing remotely, as Los Angeles prosecutors argued in Los Angeles court on Friday why they wanted to withdraw their recommendation to responsiveness to Lyle and Eric Menendez.
They heard the argument from the San Diego prison and sat together in blue prison clothes. They were wearing glasses and at one point they looked like they were reading offscreen.
Associate District Attorney Habib Varian, who announced on behalf of the prosecutor, explained to Judge Michael Jessick how Lyle pressed his shotgun against his mother’s cheek and fired it. As the secondary convention said, my brother saw him shaking a little while ago.
District Attorney Nathan Hochman sat in the first line behind the prosecutor’s team during the hearing, while the brother’s defense team led by Mark Jelagos was in court along with his brother’s family.
There were several moments of tension within the courtroom. The defense attorney criticized the prosecutors and accused them of trying to trust the former trial.
But when Judge Jesic tried to calm everyone down, he said he would have both sides tell them what they were doing.
The Vice President said, “There’s a great power to recognize when someone succeeds,” but they must use their strength wisely.
Prosecutors also denounced former Da George Gascon and said his decision to file a motion was politically motivated by the November election. Gascon lost to Hochman with about 30 points.
The Assistant District Attorney told Judge Jessick that he would focus on the lies his brothers told him when the brothers exposed their father Jose’s sexual abuse.
Varian claims that Lyle wrote the letter in 1991, saying that he needed to suffer his mother, Kitty, as a violent person trying to kill his son.
The Deputy DA also claimed that Lyle lied to his then-girlfriend and that his father had raped her violently, but refused despite Lyle’s offerings of money.
