Maryland Green Belt. – The federal judge hears from a Homeland Security official on Thursday. The next step was for Kilmer Abrego Garcia, who was mistakenly deported from the United States and is now at the heart of the legal battle over Trump’s presidential forces.

US District Judge Paula Sinis ordered the Trump administration on Monday to “have personal knowledge” and “produce personal knowledge” about Abrego Garcia’s administration’s plans. She said, “We would expect to testify about who, where, where, where, when, and when.”

Justice Department officials notified Judge Xinis that they would be calling as a witness to Thomas Giles, assistant director of the Immigration and Customs Enforcement and Removal Operations Office in Los Angeles, California, just hours before the hearing.

“Among other topics, the legal basis for detention, the nature and timing of the notice provided to Abrego Garcia, the proposed custody or place of assignment, and the procedural measures pursued by the defendant, were stated in her order.

The request comes after Justice Department officials granted a hearing earlier this week that Abrego Garcia could be removed from the United States nine days from today, when a federal judge in Tennessee should be released and transferred to DHS custody.

Abrego Garcia, currently being held by the US former S. Tennessee, was returned from El Salvador in June. Three months after his deportation, a few weeks after the Supreme Court upheld Sinis’ order to promote his return.

Upon arrival, Abrego was immediately slapped on a federal charge resulting from a traffic stop in 2022. Justice Department officials confirmed this week in court that they plan to take him to ice custody this month soon, and expel him to a third country, regardless of his position in the criminal case.

Cinis, who handles civil lawsuits, has grilled Trump administration lawyers in detail about when he launched a federal investigation of Abrego Garcia in the Central District of Tennessee and how the timing of the investigation and federal accusations and the timing of his case was squared with his own court testimony.

She took umbrella on the timeline of the criminal investigation duel, noting that she began an investigation into Abrego Garcia in the Central District of Tennessee on April 28, 2025, due to her own hospitalization.

“Now I have real concerns, as if I haven’t been there for the last three months,” Xinis responded.

A Justice Department lawyer also told Xinis he would not keep him in the US until his trial is over.

“No,” Justice Department lawyer Jonathan Ginn simply replied.

“We don’t have the intention to put him under ice custody while we wait for the criminal case to unfold,” Gin told Xinis. “He will be removed, just like any other illegal alien in that process.”

Here, “considering a series of illegal activities,” I feel that ordering this hearing is within my authority, and that I often hear testimony from at least one witness with direct knowledge that can answer these questions from governments with which the government has reserved custody.
