A federal judge ruled that President Donald Trump acted illegally when he seized control of the California State Guard during an ice-related riot in Los Angeles.
US District Judge Charles R. Breyer issued the decision Thursday, monitoring with Gov. Gavin Newsom and ordered Trump to return security control to the state “quickly.”
“His actions were illegal. Both are beyond the scope of his statutory authority and violate the 10th amendment to the US Constitution,” Breyer wrote. “Therefore, he must immediately return control of the California National Guard to the governor of California.”
“Federalism is not an option,” the ruling states. “Even the president cannot legislate through Fiat.”

Recent anti-ice protests have led to riots, looting and clashes with federal agents in Los Angeles. Trump issued a declaration calling for federal authorities, but Breyer refused to justify it, calling it constitutionally blank.
At his order, US District Judge Charles R. Breyer granted the plaintiff’s request for a temporary restraining order and filed an immediate lawsuit to halt the federal control of the California State Guard.
“The defendant is temporarily prohibited from deploying members of the California National Guard in Los Angeles,” the ruling states. “The defendant has been instructed to return control of the California State Guard to Governor Newsom.”

The court continued the order until noon on June 13, 2025, giving narrow windows to comply with the defendant. The plaintiff was also ordered to post a nominal debt of $100 within 24 hours.
Looking ahead, Judge Breyer had scheduled a hearing to determine whether the temporary restraining order would be a provisional injunction.
“The defendant is further ordered to show why there will be no interim injunction,” Breyer wrote. The hearing is set at 10am on June 20th, 2025.”
