Judge Sonia Sotomayor blasted six of her colleagues in the Supreme Court on Wednesday with furious opposition as she decided to support Tennessee’s law banning certain transgender medical treatment for minors.
Sotomayor said the 6-3 decision issued along the ideological boundaries in the US vs. Skulmetti improperly discriminated against minors based on their gender. Liberal justice has made atypical moves read her dissenting views from the bench.
Sotomayor, appointed to court by former President Barack Obama, said the majority “refused to call spades spades and that Tennessee’s bill could withstand constitutional tests to “obfuscate sex classifications.”

“The court’s willingness to do so here will invigorate irrevocably damage the equal protection clause and invite Congress to engage in discrimination by clearly hiding the blatant sexual classification,” Sotomayor said. “It also allows us to avoid harming trans children and their loved ones and their parents and families without thinking about it again.”
One of the most closely monitored cases of High Court tenure, the case stemmed from the Biden administration, which sued a 2023 bill to ban adolescent blockers and hormone therapy as treatment for minors identified as transgender.

Sotomayor said Judges Ketanji Brown Jackson and Elena Kagan opposed, but said doctors would provide such treatment based on patients with lost gender. Sotomayor argued that laws prohibiting the practice require a high level of scrutiny that the Supreme Court majority did not recklessly apply.

“The majority impose laws that explicitly discriminate against merely a rational basis review,” Sotomayor wrote. “By withdrawing from meaningful judicial review where it matters most, the courts will abandon transgender children and their families on a political whim. In grief, I oppose it.”
The Supreme Court’s decision effectively allows states that pass laws like Tennessee to ban certain medical procedures for minors.
