Louisiana AG hand over a New York doctor who prescribed abortion medication

New York Governor Kathy Hochul refused to file a complaint with Louisiana Attorney General Liz Maryll on Thursday, handing over a New York doctor who allegedly prescribed abortion pills and mailed to his Louisiana mother.

“The Louisiana Governor has sent a handover request request for New York over a doctor who provided reproductive health care, which is denying the request,” Hochul said.

Maril announced Wednesday that he had filed a motion to hand over Dr. Margaret Carpenter. Dr. Margaret Carpenter was charged last month by a Louisiana large ju trial for providing abortion pills to pregnant women to pregnant women.

“We will take all legal action to enforce the criminal laws of this state,” Murrill said.

“We have sent law enforcement notices that certain out-of-state warrants are not enforceable in New York,” Hochul replied Thursday. “So anyone who pulls or gets caught up in a situation where a doctor is protected under our laws is told, “You should not cooperate with this extradition.” It’s there. So I would like to make it clear that we have taken every step we can to protect this doctor. ”

Since the indictment, Hochul has said he will not comply with extradition and has signed a law requiring doctors to omit their name from prescribing abortion medication.

“Under any circumstances, we will never hand this doctor over to Louisiana under an extradition request,” Hochul said.

Muril said Hochur had no authority to resist the extradition.

“New York officials, including governors, have no freedom to ignore interstate compacts and laws regarding extraditions. As for new laws, doctors who prescribe these drugs and deliver them in our state are committing crimes. The bottles don’t protect them,” Maryle said.

Muril warned Carpenter to take a warrant for his arrest and beware of his travel plans.

“The NCIC system has an arrest warrant. Doctors could be arrested elsewhere. If New York doesn’t cooperate, there will be other states,” Murill said.

After the indictment, Hochul doubled her commitment to protecting New York’s reproductive access from “anti-abortion politicians.”

“We’ve always known that we’re overturning Roev. Wade. That’s not the end of the road for anti-abortion politicians. So, I’m working with Congress to help people with providers and patients. I passed a nationally leading law to protect it, and I will never step back from this fight to step up and protect reproductive freedom,” Hochul said.

The case represents the first known criminal charges of a doctor charged with abortion prescription drugs across the state line.

Louisiana has one of the most restrictive abortion laws in the country. Roev. Abortions have been illegal in Louisiana since Wade was overturned in 2022. The only exceptions are pregnancy and mother’s life that is insurviving.

New York has moved in the opposite direction since the DOBBS decision. The Blue State this year under the leadership of Hochur, stipulated its constitution to access abortion.

“Louisiana has changed the law, but that’s not related to the law here in New York. Doctors have made oaths to protect patients. I have taken oaths to protect all New Yorkers. Not only does our constitution, but there are laws of our land.
