Conservative legal groups are trying to clarify whether the previous Biden administration focuses on diversity, equity and inclusion (DEI) initiatives.
MAGA Law Group America First Legal is suing many federal health agencies to obtain documents related to the country’s organ transplant system.
Specifically, they are targeting the Department of Health and Human Services, the Centers for Medicare and Medicaid Services, and the Office of Health Resources and Services Management to force them to take over documents related to the Organ Procurement and Transplant Network (OPTN).
In April 2023, the AFL filed a Freedom of Information Act (FOIA) request for documents relating to the Biden administration’s efforts to inject DEIs into the organ transplant system. However, up until now, the AFL has said it has not received the requested information and as a result, it has decided to sue in an effort to force the release.
“The Biden administration infected the federal government with “equity” and replaced traditional equity and needs with race-conscious standards,” said Will Scorinos, the first American lawyer. “AFL has decided to clarify the full scope of its Biden-era DEI policy and will continue to take critical action to restore Color-Blind Healthcare.”

Just a few days after taking office in 2021, former President Joe Biden signed Executive Order 13985 to direct all federal agencies to implement “stopping stock valuations” to determine whether “underserved communities and their members” face systemic barriers to access federal programs. The order also required agencies to develop an action plan to address these barriers.
As part of this effort, in December 2021, CMS issued a request to the public for comment on the fact that institutions can “reduce and reduce disparities in organ transplantation.”
“The CMS focuses on identifying potential system-wide improvements to increase organ donations, improve transplantation, improve quality of care at dialysis facilities, increase access to dialysis services, and increase advance equity in organ donation and transplantation,” the said at the time.

Meanwhile, a few weeks later, HRSA announced that “labeling of organ donor race and ethnic information” will be “changed in many data reports available on the Organ Procurement and Transplant Network (OPTN) website.” According to the HRSA, the move made the data “more clearer, more consistent and easier for users to interpret,” and didn’t affect how data was collected. Optn collects and manages data on waiting lists, organ donation, matching and transplants for patients in the US
HRSA also announced Optn’s ‘modernization initiative’ around the same time. This included plans to “enhance the ‘equity’ of organ donation and transplant systems.

“The last administration’s broader mandate, which requires consideration of unchanging characteristics such as race, color, and ethnicity, should be relevant to all Americans to make healthcare more “fair”,” Scorinos said Tuesday. “AFL has decided to clarify the full scope of its Biden-era DEI policy and will continue to take critical action to restore Color-Blind Healthcare.”
HHS declined to comment on the AFL lawsuit.
