The man is facing life in prison after being convicted of two degrees of murder in connection with a DUI crash crash that killed a woman helping at the scene of an early crash in Oxnard.
The Ventura County District Attorney’s Office said on July 22, 2018, Francisco Garcia was driving east on Pleasant Valley Road when he attacked two disabled vehicles involved in the previous crash. Elysia Lopez Hernandez, 52, of Oxnard, was killed in a collision.
“Several individuals left the vehicle and assisted when Garcia’s vehicle ploughed the scene, killed Lopez Hernandez and seriously injured another person,” the DA’s office said in a news release. “Both victims were good Samaritans supporting previous accidents.”
Shortly after the crash, Garcia escaped on foot, but later hid on a nearby rooftop.
Francisco Garcia can be seen in images provided by the Ventura County District Attorney’s Office.
Garcia, who the DA’s office said “drinking lots of drinks all day,” was later tested at a blood alcohol concentration of 0.24%.
Garcia was found guilty of multiple charges and special allegations listed below.
PC 187(a) – 2nd Degree Murder VC 23153(a) – Driving Alcoholic Drink Driving VC 23153(b) – Driving with 0.08% Blood Alcohol Caused to Injury VC 20001(b)(2) – Escape from the scene of an accident that causes permanent serious injuries
Special claim:
CRC 4.421(a)(1) – Crime involved in major violence CRC 4.421(a)(3) – Victims were vulnerable to CRC 4.421(b)(1);
The DA’s office said Garcia, 49 at the time of the crash, had received Watson advice from the court following her previous DUI conviction in 2009.
“Watson’s advice was a warning given to a California driver convicted of DUI and said that if they were affected again and someone was killed, they could be charged with murder,” the DA’s office said.
Garcia faces 22 years of life in a state prison and is due to be sentenced on August 6th.
