The eight immigrants were denied a request by a federal judge in Massachusetts on Friday to halt deportation into South Sudan.

Justice Department lawyers said the man is scheduled to fly to South Sudan at 7pm on Friday after two courts considered the emergency request on July 4th and then on the day the court closes.

Immigrants from Cuba, Laos, Mexico, Burma, Sudan and Vietnam filed new claims on Thursday after Boston federal judge Brian Murphy made it clear that he could not request the Department of Homeland Security to retain them.

Also on Friday, Washington federal judge Randolph Moss suspended the Trump administration’s efforts to deport eight immigrants to South Sudan. This is the latest lawsuit that tested the legality of the Trump administration’s push to ship illegal immigrants to third countries.

Moss temporarily suspended deportation after immigration lawyers filed a new claim in his court and sent the case to Boston, where Murphy denied his claim.

Eight men claimed that deportation into South Sudan violated the constitution, which banned “cruel and unusual” punishments, Reuters reported. They have been convicted of various crimes, four of whom have been convicted of murder, the Department of Homeland Security said.

Instead of being brought back to the US, they were detained for six weeks at a military base in Djibouti.

On Thursday, immigrants filed new claims after a Boston federal judge said they could not request the Department of Homeland Security to retain them, Reuters reported.

Trump administrators ask Scotus to allow rapid deportation of immigrants to countries other than their own.

During his hearing with Moss on Friday, government lawyers argued that the agreed order to halt deportation poses serious problems for US diplomatic relations and would make foreign countries less likely to accept immigrant transfers in the future.

The incident is the latest development on the legality of the Trump administration’s campaign to block immigration by following transactions with other countries and shipping them to places outside their country of origin, according to Reuters.

“It seems almost obvious that the US government cannot take humans and send them to situations where their physical well-being simply punishes them or risks signaling others,” Moss said at the hearing.
