netflix has been sued by a former employee for alleged discrimination and retaliation

A former senior labor lawyer for Netflix has filed a lawsuit against the streaming giant and its two executives.

A complaint filed by Pasadena-based civil rights law firm Hadsell Stormer Renick & Dai (HSRD) alleges that Netflix, together with senior director Ted Sinclair and executive Jonah Cozien, tried to silence whistleblowers by violating federal anti-retaliation laws and forcing them to private individualize.

The plaintiff’s NHU fans are represented by HSRD lawyers Brian Olney and Kate MacFarlane.

According to the lawsuit, Phan joined Netflix in 2021 and quickly rose to the ranks due to an internal rating described as an exemplary job. One such rating from her former supervisor, Cozien, reportedly referred to her as a “great asset” with “full courage, great communication, outstanding integrity.”

Despite these positive reviews, the complaint alleges that Sinclair, who oversaw labor relations for most of Netflix’s scripted content, discriminated against Phan and other women of color by removing them from important opportunities and attribute their work to White’s colleagues.

Fans said they raised internal concerns on multiple occasions, including HR and senior leaders. She claimed the company was unable to act and later promoted Sinclair in 2023.

The man pleaded guilty to a $13 million federal fraud case

After requesting a new supervisor, fans were reassigned to Kojien in August 2022. The complaint alleges that Kodien later found herself sexually harassing a young female colleague. Fans said she reported HR harassment.

After the report, Kojien is said to have retaliated against her. The fans ended shortly thereafter.

According to HSRD, Netflix filed a lawsuit against her to force arbitration. Her lawyer says this violates federally-tier forced arbitration of the Sexual Assault and Sexual Harassment Act.

“Netflix is a corporate bully who does anything to avoid responsibility for its actions,” HSRD partner Brian Olney said at a news conference. “Nhu Phan had the courage to blow his mouth off about Netflix executives who discriminate against women of color and sexually harass female employees.

Attorney Kate MacFarlane added: “Nhu Phan was brave enough to talk about the culture of discrimination and harassment by powerful men on Netflix. As a result, Netflix fired her, promoted abusers and tried to silence her.

KTLA contacted Netflix for comment. The spokesperson replied, “There is no merit with these claims and I intend to defend this issue vigorously.”
