A New Jersey legislator who was involved in a highly publicized altercation outside immigration facilities last month is scheduled to appear in court later today to face charges that allegedly obstructed a homeland security officer.

Rep. Lamonica Mciver, Dn.J., is charged with a three-count indictment of forcing a federal officer to obstruct the arrest of Newark Mayor Rasbaraka at the Delaney Hall Immigration Facility on May 9. She says she will not commit a crime.

McIver and two other Congresses said they were conducting Congressional oversight visits in line with immigrant protests when clashes with federal agents broke out.

According to a press release from DOJ, Baraka was allowed to enter a safe area of the facility, and federal agents warned him to leave, but he refused to do so.

When officers tried to arrest Baraka, McQuiver blocked them, placing his arm around the mayor and grabbed another officer and said he “slammed him on the forearm.”

Each of the first two counts is sentenced to a maximum of eight years. The third is carried up to the first year.

The charges represent US lawyers for the New Jersey area Alina Haba area, who has represented President Donald Trump between his two presidents. Habba previously said that Mciver “attacked, obstructed and obstructed law enforcement.”

McQuiber condemned the charges earlier this month, comparing them to previous attempts by the Trump administration to silence its political opponents.

Dem defends the “storm” of the ice facility, and Trump administrators say they are “liing on all levels.”

“The facts of this case will prove that I am merely doing my job and will reveal these cases as to what they are: a brave attempt at political intimidation,” McQuiber said in a statement.

“This indictment is less justified than the original accusations, it is an effort by the Trump administration, a Trump administration that has caused and scared me by doing the work I was chosen to do,” she continued.

“But that doesn’t work. I’m not threatened. The facts are on our side, I’m going to enter a plea of innocence, I appreciate the support of my community and I look forward to my day in court.”

Newark Democratic mayor Las Baraka will speak outside the Delaney Hall Ice facility during the protest. A security officer will be standing in front of Delaney Hall on May 7, 2025.

Baraka was arrested, but committed a crime of trespassing against him.

Meanwhile, the liberal watchdog group, the Campaign for Accountability, filed an ethical complaint with the New Jersey State Office of Lawyers Ethics on Tuesday, accusing Haba of serious ethical misconduct in connection with McQuiver’s prosecution and Baraka’s arrest.

The complaint alleges that their policies contradict the Trump administration’s policies and that they were politically targeted in retaliation for participating in protests and surveillance visits.
