Top Los Angeles prosecutors are scheduled to ask the judge to responsive requests to Lyle and Eric Menendez on Friday, and are being advised to his brothers seeking freedom.
LA County District Attorney Nathan Hochman said his office would ask the court to withdraw resentengenting recommendations filed by his predecessor, George Gascon. Last month, Hochman said the brothers didn’t meet the standards of resting as their siblings were unable to fully accept accountability for their parents Jose and Kitty’s 1989 murder.
Speaking to the NBCLA news conference with Conan Nolan, Hochman said, “We’ve doubled the attitude that the brothers are likely not released from prison through his office.
If a brother’s sentence is granted, the court has the power to turn a brother’s life sentence into a lifetime of parole without the possibility of parole and allows them to leave prison while under the supervision of the parole board.
“The (Newsom Government) has the unilateral constitutional power to commute Menendez’s sentences today, tomorrow or any day, and to release them if they are considering doing so through the interests of justice,” explains Newsom that he or the court has no legal restraint to do so.
“If the Menendez family wants to get the Menendez brothers out of prison as soon as possible, the cleanest path is to go straight to Sacramento and the governor’s office,” Hochmann said. ”
Defendants for Lyle and Eric Menendez also filed a motion opposed to the resententenging recommendation, rejecting Hochman’s claim that the brothers were not fully owned by the crime.
“From the day they were convicted, they matured in prison for many years from the trial, so in both court filings and public interviews they held liability for the shooting and expressed deep regret,” the defense said in response to people’s motions that they would withdraw the resentengentencing recommendation.
During a court petition Friday, the DA’s office can call witnesses, including previous prosecutors in the case, to testify and support the decision to reverse the ruling recommendation.
Resententengentenging Hearing may be set for April 17th and April 18th based on what the court decides on Friday.
The state’s considerations for the Menendez brothers could end in June as they are expected to appear before a California parole hearing in June, Newsmom said in his podcast, adding an independent risk assessment that would allow a group of experts and psychologists to look into whether the brothers pose a risk to the public.
