Details of the death of Oscar Omar Hernandez, a 13-year-old North Hollywood boy who was found on the road in Oxnard, have been revealed.
Hernandez died of acute ethanol poisoning, according to the Ventura County Medical Examiner’s office.
Mario Edgardo Garcia Aquino, 43, who was already under investigation on two other sexual assaults, has been charged with murdering Hernandez.
Hernandez’s body was found in the ditch in Oxnard in April. His family had reported that he went missing on Sunday, March 30 after he failed to return from a visit with a Lancaster/Palmdale area coach and failed to answer the phone.
Garcia Aquino is also facing another charge arising from alleged sexual assault on February 22, 2024 in Palmdale.
“Garcia Aquino has become friends with Sylmer’s family who allowed the boy’s son to stay with him at his residence in Palmdale,” Luna said.
The lawsuit, filed in April, charged Garcia Aquino with a single count of first-degree murder and with a special circumstance claim that the murder occurred during another violent felony committee, including robbery and rape.
Garcia Aquino faces six years in prison for sexual assault, at least without the possibility of parole on murder charges.
LA County District Attorney Nathan Hochman, who announced his office was seeking the death penalty again, said he would consider seeking Garcia Aquino’s death penalty.
