Republicans on the Senate Judiciary Committee warned Democrat colleagues that they were boycotting from a Wednesday morning hearing that examined health decline when former President Joe Biden was in an oval office.
“Most of my Democratic colleagues will find themselves here today,” Republican Texas Sen. John Cornyn said Wednesday. “Thank you to Senator Welch from Vermont for being here, and there is no other option to boycott this hearing as acknowledgement of guilt for their role in this crisis.
“We must not turn our backs on exploring answers. It is not an exaggeration to say that our country’s future depends on how we choose to act or not to act on this very problem at some point,” Konin continued.
The Senate Committee held a hearing Wednesday morning called “Not Suitable to Serve: How Biden put America at risk and undermine the Constitution.”

Vermont Democrat Sen. Peter Welch and Illinois Democrat Sen. Dick Durbin attended the hearing to be distracted and after Republican colleagues accused him of “sleeping on the wheels” with other legal issues within the Trump administration for focusing on Biden.
“Several events have called for immediate attention from this committee last week alone,” Durbin said Wednesday. “The horrifying assassination in Minnesota, the treatment of fellow Los Angeles Sen. Padilla by federal agents, and President Trump’s unprecedented deployment of US forces in Los Angeles.
“We should listen without delay from Attorney General Bondi and Attorney General Patel, Director of the FBI, about what they are doing to deal with the unacceptable political violence in our country, including the threats to Article 3 judges and judges, members of Congress,” Durbin said. “And we need to hear from Homeland Security Secretary Noem about his fellow Sen. Padilla and his administration’s massive deportation campaign against immigration.”
Welch also left the hearing after declaring that he would not benefit his members.

The Senate Judiciary Committee has 10 Democrats, including Senator Klobuchar of Minnesota, Cory Booker of New Jersey, and Adam Schiff of California. A Democrat spokesman for the Senate Judiciary Committee directed Fox Digital to Durbin’s first attendance and his remarks when asked about GOP lawmakers who claimed boycotting the Democratic hearing was guilty.

“There’s no single Democrat here today because one of them hasn’t given a D for the fact that he’s lying to an American for four years,” Cruz said at the hearing. “They knew. They knew Joe Biden was not mentally capable of doing work. When they stood in front of Americans and lied over and over again, they weren’t here because they couldn’t protect themselves.
Other Republicans opposed Democrat counterparts, including Missouri Republican Sen. Eric Schmidt, who skipped hearings.
“Today, when we try to answer this question, it is very unfortunate that most Democrats on this committee have chosen everything but boycotted the hearing and failed to call a single witness,” Schmidt said at the hearing. “They chose to ignore the issue as if they ignored President Biden’s decline. Their absence speaks of an implicit recognition that the truth is too inconvenient to face. By refusing to engage in this critical exam, they refuse to abandon their responsibility to the Americans.
“The title of the hearing, ‘not fit to serve’, captures a calm and undeniable truth,” Schmidt added. “President Biden was mentally unfit to carry out the responsibilities of the world’s most powerful office. Given his inability to become a part of the American public, it deserves to know who has run the country for the past four years.”

The hearing included testimony from three experts, including University of Virginia law professor, Professor John Harrison, Theodore Wald of the Conservative Think Tank Heritage Foundation, and Sean Spicer, the former White House press secretary for the first Trump administration.
Concerns about Biden’s spirituality hit the fever pitch in 2024 as the election cycle heated up when the then-president announced a disastrous debate performance against the current President Donald Trump in June. The argument opened the floodgates of criticism, including traditional Democratic allies who wanted Biden to drop out of the presidential race after conservative mental vision was slipping and claiming he was unfit to serve as Commander-in-Chief.

His health concerns continued even after the president’s tenure ended, including the revelation that Biden administrators frequently used autopens to sign official presidential documents, the release of an interview with former special advisor Robert Huar, and the shocking announcement of prostate cancer in May.
The Conservative Heritage Foundation Surveillance Project first investigated the Biden administration’s use of autopens in early 2025, finding that the same signature was found in the executive order and other official documents bevvy, but Biden’s signature, announcing his departure from the 2024 race, differed by the apparent machine-making signature.

Heritage Fellow Wald testified before the committee, describing Biden’s allegedly cover-up of declining health as a “constitutional crisis.”

“I’m going to say the 25th amendment. It’s a modern gimmick, but it’s still consistent with the American Constitution. The American Constitution assumes that American officers act skillfully and morally,” Waldo said. “And the idea that members of the Cabinet will be the length of shunning an oval office to abstain from the responsibility of verifying the appropriateness of the president’s eyesight or the ability to authenticate actions taken by the President. If that’s not a constitutional scandal, honestly, I don’t know what constitutes such a thing.
“It could be a crime,” he said. “And the 25th revision works only with that only mechanism if people are actually willing to call a spade a spade.”
