The Senate narrowly voted to move forward with the appointment of former Trump lawyer Emil Bove on Tuesday in consideration of the federal court of appeals.
In the 50-48 vote, there was one Republican break rank, and voted against his nomination, but Democrats did everything in their power to slow the nomination. Bove, who currently works for the Department of Justice, has been appointed to serve in the Third Circuit Court of Appeals.
Democrats argued that Bove, former defense attorney for President Donald Trump, is not fit for the role, pointing to allegations that he proposed behind closed doors that the Trump administration could simply ignore the judicial order. Bove denied these allegations.
Sen. Susan Collins, R Maine’s, voted to move forward for Republicans, but in a statement she said she would oppose Bove’s confirmation in the final vote. Alaska Sen. Lisa Murkowski was the only Republican opposed to moving forward with Bove’s nomination.

“We must have a judge who adheres to the rule of law and the constitution and does so regardless of what their personal views are,” Collins said in a statement. “We conclude that Bove’s political profile and some of the actions he has taken in his leadership role at the Ministry of Justice do not serve as an impartial legal scholar.”
Democrats on the Senate Judiciary Committee were out of the meeting that the committee approved Bove last week.
Senator Cory Booker (DN.J.) tried to promote more discussion time, but R-Iowa Chairman Chuck Grassley moved the vote forward.
“What are you afraid of?” Booker explodes after Grassley spoke about him and tried to vote. “I’ll discuss this [nomination]put things on the record – dear God,” he said, “That’s what we’re here.”
“What are they saying to you,” he said, referring to the Trump administration.

Booker concluded his sharp interaction with Grassley, saying, “This is wrong, Sir, and I’ll join with my colleagues to leave.”

It comes as Trump administration officials seek to become an “activist” judge who argues that they block the president’s agenda and prevent him from enacting his drastic policy goals, including border security and cracking down on immigration.
