Sen. Tom Tillis’s office dispels concerns that left courts could choose interim US lawyers for the District of Columbia after North Carolina Republicans chose President Donald Trump for the role.
Tillis of RN.C. is on the Senate Judiciary Committee, which oversees the confirmation process for Trump’s election Ed Martin as US lawyer for the District of Columbia. Martin has been an interim US lawyer since Trump took office on January 20th, but has been confirmed to face a May 20 deadline.
Martin met with the senators on Monday, and said Tillis would not support the nomination to reporters on Tuesday. The committee, made up of 12 Republicans and 10 Democrats, has yet to schedule a vote on Martin’s nomination.
“I have shown the White House not to support his nomination,” Tillis told reporters Tuesday.

However, if an interim US lawyer has not been confirmed by the Senate within 120 days, a U.S. District Court judge for that district can name a new interim US lawyer until the role is met. Trump’s antagonist judge James Boasberg is an Obama-appointed judge at the heart of a legal effort targeting Trump’s deportation efforts and is the Supreme Court justice of the U.S. District Court for the District of Columbia.
When asked if Tillis was happy to choose a temporary US lawyer for the left, his firm told Fox New Digital that attorney General PAM Bondi could choose an acting alternative and bypass involvement from federal judges.

“Our understanding is that if the Senate does not confirm a US lawyer before the term of representation of the US lawyer expires, the Attorney General can choose a next acting alternative before the original appointment expires under 28 USC 546,” a Tillis spokesman said on Tuesday.
Tillis’s office referred Fox News Digital to 28 US code §546. This states that “If an appointment expires under subsection (c)(2), the district courts of such districts may appoint a US counsel until the vacancy is met. An order of appointment by the court will be submitted to the court’s clerk.”

Martin previously worked as a defense attorney and on behalf of an American indicted on January 6, 2021, rioted in the Capitol, where Tillis had trouble talking to reporters on Tuesday.
“Mr. Martin did a good job explaining areas he thinks he is probably right. “If Mr. Martin was issued as a US lawyer for a district except for the district where January 6th occurred, I would probably support him if there was a protest, but that wasn’t the case in this district.”

Tillis had previously opposed the January 6 protest when Trump supporters violated the US Capitol after the 2020 election. When Tillis criticized Trump in January, he gave generosity to criminal defendants who were on January 6th and above when the president took office.

“Anyone who commits violence, like the violence in Kenosha or the violence in Portland before them should be in prison – period, complete suspension,” Tillis said after the pardon. “That amnesty segment – I’m just as disappointed as all the amnesty Biden did.”
Trump and his administration garnered support for Martin as his confirmation process came down to the wire.
“His approval is essential in that it is doing everything that needs to be done to save lives and make America healthy again,” Trump wrote of the True Society.

Fox News Digital reported that 23 state attorney generals have also sent letters to Senate majority leader John Thune and Senate Judiciary Committee Chuck Grassley, calling lawmakers to quickly confirm Martin as a US power of attorney.
“Frankly, the District of Columbia is broken,” the letter sent Monday said. “And for four years of corruption, mismanagement and abolition at the US Lawyer’s office based on President Biden’s appointee, we need to be responsible in many ways. Districts need US lawyers who will replace legal rules with legal rules.

“We are proud to lead this effort to support Ed Martin, because he is already a proven leader who has dedicated all his time to restore the rule of law in our country’s capital,” Indiana Republican Attorney General Todd Lokita said Fox Digital had told Fox Digital that Martin had supported him.
“His bold actions had an immediate impact, which has led to a full-scale meltdown for the dishonest DC news media. The Senate must confirm him and act quickly to ensure that his critical work is not interrupted.”
