Some fentanyl dealers will be charged with felony murder under the new bill

First on Fox: New laws were introduced in both the House and Senate on Tuesday, connecting Fentanyl dealers to the distribution, allowing the deceased to be charged with felony murder.

Current US law provides prisons for at least 20 years for the same crime, but prosecutors’ legal proceedings are not brought to trial as murder cases. The law will increase dealer severity and consequences for further crackdowns on the fentanyl crisis, which has killed around 280,000 Americans since 2021, according to the Centers for Disease Control and Prevention (CDC) and the National Institute of Drug Abuse (NIH) (NIH).

Senator Joni Ernst of R-Iowa and Rep. Tony Gonzales of R-Texas announced the Deadly Fentanyl Distribution Act felony murder act as a bi-headed bill on Tuesday. The Act heads to the committees of both rooms.

“Drug cartels use loopholes at our borders to sell illegal drugs to our country, our community pays prices,” Gonzalez told Fox News Digital. “My bill sends a strong message to people who work with cartels and other bad actors. If you sell drugs and take an innocent life, justice is delivered. Our law enforcement is on overdrive fighting the American drug outbreak.

Though the number of deaths is hundreds of thousands, the Department of Homeland Security (DHS) estimates that “nearly 64,000 pounds of fentanyl have been seized on the southern border,” which can “kill 14 billion people.”

“I’ve seen firsthand how the fentanyl tragedy has caused an incredible tragedy to the Iowa community,” Sen. Joni Ernst told Fox News Digital on Tuesday. “I have worked for years to protect Americans and stop this deadly epidemic. It has long been delayed to increase the severity of punishment for drug dealers against those responsible for Iowan deaths.”

The White House touts 100-day crackdown on illegal immigration after Biden as “deliberately not protecting the border”

Tom Homan recently claimed that the Biden administration “deliberately fails to protect its borders” and lends it to the rise in illegal immigration that brings fentanyl to the US (DEA Rocky Mountain Division/X).

The fatal increase in drug flows has been heavily linked to the influx of illegal immigrants over the past four years of the Biden administration. Customs and Border Patrol (CBP) estimates that “more than 90% of intervened fentanyl are suspended at ports of entry (POE) and cartels attempt to smuggle in vehicles driven primarily by US citizens.”

As recent border concerns have decreased, deaths caused by fentanyl consumption have also decreased. The CDC was reported in February, with the latest data showing deaths from drug overdose, a 24% decline between October 2023 and September 2024.

President Donald Trump’s border emperor Tom Homan, insisted at a White House press conference Monday morning that the Biden administration would “deliberately protect the border.”

Homan went on to say that “the number of borders is historic low” and that the United States has “the safest border in the country’s history.”
