South Carolina’s Supreme Court Rules in Medicaid Funding
The Supreme Court ruled Thursday that South Carolina has the authority to block Medicaid funds for planned parent-child clinics in its technical interpretation of healthcare choices that emerged as a larger political battle for abortion access.
This incident is Medinav. Planned Parenthood South Atlantic, known as Section 1983, as part of the Civil Rights Act of 1871, is centered around whether low-income Medicaid patients can choose a qualified healthcare provider.
This includes South Carolina blocking Medicaid funds for planned parent-child South Atlantic, claiming the organization violated federal law. In its 6-3 decision, the court said that a typical relief for such a violation would be for the Secretary of Health and Human Services to withhold Medicaid funds from the state and not for individuals to sue the state.
“Section 1983 allows a private plaintiff to sue for violations of the Federal Expenditure Power Act only in “atypical” circumstances…where the provisions in question are clear[ly]’And’ clear[ly]”We “right” individuals,” Judge Neil Gorsuch wrote in a majority opinion, finding the issue “is not such a law.”
