The Los Angeles County District Attorney’s Office has been ordered to explain why evidence supporting the allegations of sexual abuse by the Menendez brothers at the hands of his father Jose will not be shared in Eric and Lyle’s second trial.
On July 7, Superior Court Judge William Ryan ruled that the DA’s office must provide an explanation of withholding within 30 days of his decision, court documents say.
According to court documents, in the brothers’ second trial, two experp umpires were not shared with the ju umpires. It contains evidence:
In a letter in 1988, Eric Menendez wrote to his cousin Andy Cano, Eric described the sexual abuse he endured. A declaration from Roy Rossello, a former member of the Latin pop group Menudo. This was signed under the RCA record, where Jose Menendez was a high-level executive. The singer came forward and said that Jose had drugs and raped him when he was a teenager.
“The (defendant) argues that this new admission is against the prosecutor’s claim that Jose is “suppressed, tolerant” and “not a violent and brutal man.”
Ryan’s ruling also said the evidence likely changed the outcome of the brother’s second trial.
Lyle and Eric spent time behind the bar at their family’s Beverly Hills home in the 1989 murder of their parents Jose and Mary Luise “Kitty” Menendez. Prosecutors alleged that the murder was executed to earn money for their parents, but the brothers said their motives were the result of years of abuse.
Earlier this May, Judge Michael Jessick replied his brother to 50 years of life in prison and qualified for parole. Eric and Lyle’s parole hearing, originally scheduled for June, was then pushed back on August 21st and 22nd.
