The lawsuit accuses black and Latin students illegally giving blacks and Latin students.

Federal lawsuits have accused the University of California that the California is illegally considering races when accepting new students. It defeated positive actions.

This lawsuit representing Asian Americans and white students who are considering applying for a UC campus as a student in the first year, or as a student in the Faculty of Law, and on Monday to the Central Court of Central Central, California. It was raised. The UC has argued that the constitution is “giving a discriminatory appointment to non -Asian racial minorities” in violation of the equality protection clause and the 1964 Civil Rights Law.

On Tuesday, UC representatives said that they had not filed an official.

“If it is provided, we will violently defend entry practices. This is not worth aiming to distribute us from our mission to provide world -class education to California students. I believe it is a lawsuit, “said UC’s statement.

“Since the study of hospitalized races in California in 1996, the University of California has adjusted admission to comply with the law. We are all qualified students and all qualified students. The application for enlargement of the access is not shared with the student race and ethnic information only for statistical purposes. Is not used.

The plaintiff’s leading lawyers and racism include American First Legal people established by Steven Miller, President Trump’s policy deputy director. The group is also represented by Jonathan Mitchell, a former Texas lawyer.

UCs are forbidden to consider enrollment races under the proposition 209, as in all civil education institutions in the state. The ban in 1996 prompted the UCLA and UC Berkeley blacks and Latin students to enroll. The university has developed more overall enrollment practices and outreaches in college counselors, high schools, and non -white communities, and their entry has recovered over many years.

The Supreme Supreme Court ruling in 2023 has overturned positive actions, enrolling in black and Latin students, driving a sharp decrease at dozens of elite universities. However, UC advertises the campus by campus registration for each campus, which remains almost the same or is growing. UCLA has significantly improved black, Latin student applications and registration after the target outreach for more than 25 years.

For many years, UC has shifted to a comprehensive review that takes 13 factors, including GPA, course work, talent, and life experience, using test scores and GPA -based “Academic Index”. The admission director emphasizes that the applicant is not fully compared with all the other people, but is more directly compared to schools and colleagues in social and economic situations. Most selective universities also use the overall reviews, including USC.

Litigation stated that UC’s overall process is “from objective criteria to the more subjective evaluation of individual candidates.”

Students opposed to racism were founded last fall, led by law scholars, including Richard Thunder, a UCLA law professor and long -standing opponent of positive behavior. It is modeled on students for fair admission, a non -profit organization that filed a lawsuit in the Supreme Court for the Positive Action Program at Harvard University.

UC does not use racial data directly in hospitalization, but Thunder is an interview, and the university is “Social Economic Data” on behalf of races, such as information on racial population statistics and geographical income levels. He thought he was hired and said he was using other measures. In the overall review of applicants similar to racial preferences.

“There is a wealth of evidence that the underestimated minority has benefited when the University of California was rationally complied with proposal 209 in the first ten years after the California University passed 209. … The university ignored this evidence and did not promote legitimate educational goals in the late 2000s and 2010s, but re -introduced the illegal racial preference for virtue signatures. ” 。

For many years, the number of UC applications has increased, and all entry fees of competitive systems have declined. In this lawsuit, the UC campus is illegally used to consider the application because the admission fee of the black and Latin applicants is lower than the entrance fee of all students over time. I am claiming.

In 2010, Berkeley, California, has recognized 13 % of the black Californians applied in comparison with 21 % of all California applicants. By 2023, the gap was narrowed. Black Californians had a 10 % hospitalization rate, only 2 % lower than the overall hospitalization rate of Californians. This suit describes similar patterns on other campuses.

Litigation claims that Asian Americans have been harmful to UC hospitalization, but they have long been the highest among first -year students, compared to other racial and ethnic groups. I had an admission rate. In the fall of 2024, UC recognized 76.6 % of Asian American applicants compared to 68 % of Latin Americans, 65 % of white, and 60 % of black students.

Asian Americans account for 19 % of California high school graduates who meet the UC enrollment requirements, but the maximum percentage of UC undergraduate students is 36.3 %. Asian Americans also had the highest hospitalization rate in UC Berkeley, 16.3 %. In UCLA, the hospitalization rate was 10.4 % compared to 10.6 % of black students.

The growth of Latin Americans recognized by the UC campus reflects at least partially many qualified applicants. Number of Latin graduates in California high schools who met the UC enrollment requirements -3.0 GPA and at least a series of graduates of the C -grade university preparation classes from 2016-17 to 108,145 from 87,275 to 2023 to 2014. It has increased. To the Ministry of State Education data. The number of qualified black graduates was immersed in 9,174 to 8,998 during the same period.

The lawsuit also sought to get closer to the universities published by the university for admission practice. UC summarizes annual reports on enrollment and registration, including gender, race, sexual orientation, and other factors, and releases the campus individually.

In this lawsuit, UC HARM’s racial entry practices are “often in an important academic disadvantage because the university uses racial preference, and thus experiences worse results. He claims to have acknowledged Hispanic and Black Students.

Thunder explains in detail the theory of “mismatch”. This book is recognized by qualified universities, so if you are hospitalized at a fierce competition university, you will be disadvantaged if you are hospitalized in a fierce competition because you oppose a more qualified student. I am claiming.

Patricia Gandala, a director of the UCLA civil rights project, said Patricia Gandala, who said that the Thunder’s discussion and lawsuit were “not simply.”

“UC did a stunning job to recognize a variety of student groups in order to imagine a method that does not use race. I don’t think these plaintiffs can prove that races are used.” Gandara said.

For example, she pointed out that more than half of California high school graduates are Latin, but occupy a major part of UC hospitalization.

“Just looking at the numbers, it’s not close to the proportional place,” Gandala said. “UC is clear about what you see, and it can include various kinds of diversity other than races.”

Gandala also believes that Thunder’s “mismatch” theory is wrong.

“When the students were in a harsher situation, those students got up on that opportunity,” she said. “It’s not accepted by a harsher university, which is driven out students.”

Edward Blum, the founder of the student for a fair enrollment, said that California’s lawsuit marked the next chapter of the legal battle over college enrollment.

“The problem is what they are doing if the UC system does not use race preferences or classifications,” said Blum. “What was caused by their policy that the minority of minorities underestimated at UC schools with more competitive UC schools is growing steadily? Are you using it?

UC’s UC’s registration data, which was announced last month, has shown a year among some racial and ethnic groups. After Asian Americans, Latin Americans are the second largest groups and have grown to account for 26.7 % throughout the system. The white students dropped slightly to 19.8 %. Black students have achieved 4.8 % (slightly increased) of registration. The total is 11,257.

Former Texas’s lawyer General Mitchell said he had plans to file a lawsuit against additional universities, but did not specify which one.

“The university continues to rebel against the law by using races and gender preferences in student enrollment and teachers’ employment,” Mitchell said. “We continue to appeal to them until they adopt the entrance of the color brand and remove themselves on all the last traces of these nasty discriminatory practices.”
