The number of injunctions to halt Trump’s policies doubles its predecessor

The national injunction ordered against the first Trump administration explains more than half of the total injunctions ordered against the federal government since 1963, data shows.

A national injunction is a court order that prevents the federal government from implementing policies or laws that have a cascade effect that affects the entire country, not just the parties involved in the trial.

Trump’s first administration faced 64 of a total of 127 injunctions issued nationwide since 1963. Since 2001, 32 injunctions have been collectively issued against the Bush, Obama and Biden administrations.

Harvard reviews revealed that six injunctions were issued against the Bush administration, 12 against the Obama administration and 14 against the Biden administration.

Trump’s return to his elliptical office in January has filed more than 120 lawsuits from other lawsuits targeting activists, government officials and other roles. The lawsuit led to an injunction, in some cases nationwide, including 15 people in February alone, according to Trump’s representative attorney general Sarah Harris.

Trump filed an emergency appeal on Thursday asking the Supreme Court to narrow down three injunctions issued to halt Trump’s birthrights. An emergency appeal requires that the injunction only cover individuals who have been directly affected by the courts involved.

In an emergency appeal, Harris allegedly claimed that injunctions across the country had clashed with “a proportion of epidemics” under the second Trump administration, noting that the federal government faced 14 universal injunctions in the first three years of the Biden administration, compared to 15 levelled 15 people against Trump administrators in just one month.

“Long years of experience shows that if a judge can ban all presidential actions anywhere, then the administrative department cannot properly perform its function,” writes Harris.

Officials in the first Trump administration opposed the flow of injunctions ordered against the policies and laws of the 45th President, including the former Justice Department chief.

“The court issued a national injunction of an average of 1.5 per year to the Reagan, Clinton and George W. Bush administrations and 2.5 per year to the Obama administration,” Assistant Attorney General Beth Williams said in February 2019.

“However, in the first year President Trump took office, judges issued a nationwide injunction, an increase of 20 times, coinciding with the entire eight years of two terms issued against President Obama. It currently coincides with the total number of injunctions issued for the first 42 presidents.”

Former Trump administration attorney general Bill Barr added in late 2019 that “there are only 27 national injunctions in all 20th century” compared to the first Trump administration, compared to 37.

“Since President Trump took office, the U.S. District Court has issued 37 national injunctions to the administrative department, more than a month a month. By comparison, in President Obama’s first two years, the District Court took office in the 27th century, according to estimates of two nations vacant by the Ninth Circuit. 2019.

The Harvard Law Review found that the judge who issued the first injunction against the Trump administration was overwhelmingly ordered by a Democrat-appointed judge.

The Democratic-appointed judge ordered 92.2% of injunctions against the Trump administration. That is, only five of the 64 injunctions were ordered by Republican-appointed judges.

The Republican-appointed judge ordered all national injunctions against the federal government under the Biden administration.

Injunctions under the Bush and Obama eras are far more bipartisan, with 50% of Bush-era injunctions issued by Democrat-appointed judges and Republican-appointed judges ordered 58.3% of 12 Obama-era injunctions.
