The Obama-appointed federal judge dismissed President Donald Trump as defendant, allowing him to continue wrangle, but rejected President Donald Trump, largely rejecting the Trump administration’s demand for Doug-related legal challenges.

“The defendant is trying to dismiss President Trump as the defendant because the court cannot ban the president in carrying out his official duties,” and the memorandum of understanding added, “The court agrees.”

The memorandum’s opinions and orders have been signed by Judge Tanya S. Chatkan of the U.S. District Court for the District of Columbia.

Elon Musk “disappointed” by Trump’s spending bill, says it undermines what Doge is doing

President Donald Trump will arrive to make a statement at the National Memorial Day ceremonies at the Memorial Round Cemetery at Arlington National Cemetery in Arlington, Virginia on May 26, 2025.

“In his official ability as President of the United States, defendant’s motion to dismiss Count I against President Donald J. Trump is permitted. Count II has been denied any claim to dismiss Count I against all other defendants,” the order declares.

In a statement to Fox News Digital, a Justice Department spokesperson said: “This Department is fiercely defending President Trump’s ability to fulfill his official duties and will continue to do so whenever those cases are challenged in federal court.”

Desantis will goad council to follow FL’s Doge Blueprint as Musk’s cut is still waiting for votes

Twelve states submitted legal assignments for Elon Musk’s work on Trump’s Doge cost reduction initiative earlier this year.

“This court should restore the constitutional order and, in line with the appointment clause, order Musk to issue an order to anyone other than Doge’s executive branch, otherwise engage in the actions of US officers, and declare that previous actions have been in great effect and have no legal effect,” the complaint filed in February declared.

After focusing on the effort, Musk later said he plans to reduce the time he will spend on it.

Last week, he declared in a tweet that he “has been around 24 hours a day at work, sleeping in a meeting/server/factory room,” pointing out that he needs to focus on various business efforts.

“The situation with federal bureaucracy is much worse than I noticed,” he said Tuesday by the Washington Post. “I thought there was a problem, but to say the least, it’s a tough fight to improve things at DC.”

Alex Nitzberg is a writer for Fox News Digital.
