Tennessee legislators have introduced a bill that would allow school districts and law enforcement agencies to refuse to register as illegal immigrant students.

SB 836 states that law enforcement or public charter schools “may refuse to register or register students who are illegally present in the United States.”

Republican Sen. Botson, who sponsored the bill, said the proposal was intended to save the state’s money. According to Fox Chattanooga, the bill was amended to provide the district with the option of charging tuition fees for student registrations rather than creating requirements.

“According to this law, if you cannot prove a legal residence here, the local LEA may charge you tuition fees to address the physical nature of this law, not to refuse education to those students,” Watson said.

However, the bill was ruling Plylerv in the US Supreme Court in 1981. Contradicting current law confirmed by Doe, the state has determined that it is funding students seeking public education, regardless of immigration circumstances.

Immigration attorney Brittany Faith criticized the bill as unconstitutional and said it was proposed to challenge the Priler vs. doe ruling.

“It’s blatantly unconstitutional. They say that what it’s their goal is to set this as a challenge to Pryler vs. doe,” Faith told Fox Chattanooga.

Faith also says that schools have problems with the option of charging tuition, and that Tennessee’s tax system is on a sales tax basis.

“So they’re paying the same taxes towards a public education system where someone in legal status would do so,” she said.
