The Trump administration has filed a request to the court to suspend a temporary restraining order (TRO) issued Friday against the U.S. Immigration Customs (ICE), which is likely to violate constitutional protections through Los Angeles immigration enforcement practices.

In a 53-page order issued Friday, US District Judge Mame Eusi Mensa Frimon banned Biden’s appointee Ice from implementing a deterrent halt in California’s central district unless there is a “reasonable suspicion” that agents are illegally in the country.

Frimpong’s ruling expressly prohibits ICE from relying solely on race or ethnicity, and cites the Fourth Amendment to prohibit speaking Spanish or English in accent, place, or type of work when shaping doubts.

In a filing Monday, the Trump administration said the lawsuit was originally filed by three individual foreigners.

“But it appears to be clearly trying to manipulate the process of judicial allocation. The former petitioner’s lawyer has filed an amended complaint adding new individuals and organizational plaintiffs leveling the systematic agenda for federal immigration enforcement in the Los Angeles area,” the Trump administration wrote. “And a day later, the night before the holiday on July 4th, they filed an “urgent” ex parte complaint and asked the court to impose a straight jacket restraining order that significantly limits the government’s ability to stop and detain allegedly attending the United States. ”

The Trump administration also said the court gave them just two business days to accommodate the hundreds of pages of discoveries.

“The result is a district-wide injunction that threatens to step on legitimate immigration enforcement by hanging the light cont Damocles sword on all immigration halts,” the Trump administration said. “The government is seeking immediate stays in a modest order pending appeal and administrative stays in between.”

The Trump administration argued that Frimon ignored a recent Supreme Court decision involving a president who rejects a universal injunction. The judge’s ruling on Friday was not national, but focused on Los Angeles and the Central District of California.

“Here, immediate relief is guaranteed here, not only because of the magnitude of the legal errors of the courts, but also because of the practical consequences for the separation of power and the privilege of government sovereignty,” the submission reads. “It is unacceptable for district judges to “restructure” federal immigration enforcement activities on their own to take away “the agency’s continued judicial oversight and appropriately supervised by the government.”

Flimond hosted the hearing Thursday and considered accepting requests that have a major impact on California’s immigration enforcement. This is the state that has been central to President Donald Trump’s aggressive deportation plan.

The judge heard debate about whether to grant TRO to ICE over allegations that the agency violated its constitutional rights during the arrest of immigrants.

Frimon said at her hearing Thursday that she was leaning towards allowing TRO on Friday.

“I think it’s important that the courts do not undertake legal law enforcement activities otherwise,” the judge said.

The lawsuit was initially filed in June as a routine petition from three detainees, but has swelled into a heavy lawsuit that challenges the way ICE works.

Los Angeles Mayor Karen Bass praised the federal court’s decision on Friday to issue a temporary restraining order to halt what she described as “an unconstitutional and reckless assault under the Trump administration.”

She characterized federal actions as aggressive and harmful, reaffirming Los Angeles’ commitment to protecting residents’ rights.

Immigration rights groups and local governments, including cities in Los Angeles, Santa Monica, Culver and West Hollywood, intervened in the case, and democrat-led states submitted an outline of Amicus in support of them.

The plaintiffs alleged that ice was arrested “indiscriminately” for “brown skin” at Home Depots, car washes, farms, etc. and that ice was arrested “indiscriminately”. Authorities made arrests without “reasonable suspicions,” and sometimes violated the Fourth Amendment, mistakenly arresting US citizens in the process, the lawyers wrote.

The plaintiffs alleged that the Trump administration gave Ice an unrealistic allocation of 3,000 arrests per day, and officers pressured him to blow past legal requirements to achieve these numbers.

Meanwhile, the Trump administration has challenged the allegations and has denied fraud.

Justice Department lawyers wrote that immigrant arrests, which have included around 3,000 people, have been legally being made across California since early June.
