The judge approved the bond Tuesday for El Monte’s mother, who cared for her cancer daughter after being taken to immigrant custody last month.
Yolanda Perez, 50, was taken into custody on February 24th. Last week she saw the judge at her first immigration hearing. Meanwhile, the lawyers filed a request for a hearing to determine whether Perez could be released on bonds.
On Tuesday morning, the judge approved Perez’s bond. Perez was expected to be released within hours.
Xitlali Tejeda, her 20-year-old daughter, travelled from El Monte to San Diego on Thursday morning for her first hearing, but the process lasted just a few minutes before Tejeda entered.
“She means everything to me. She seems to be my right hand,” Tejeda said. Tejeda relied on her mother as the primary caretaker when she underwent chemotherapy. “She cooks for me. She does everything for me. She changes me. She showers me. She’s there for me. She’s there for me. She won’t leave me alone. If I’m in the living room, she’ll come with me. If I’m in the room, she’ll lie with me. She won’t leave my side.”
Yolanda was arrested outside Elmonte’s home in February. The immigration agent targeted his son, Jonathan.
David Akalin, the family’s lawyer, said Jonathan spent time in rehabilitation.
“It’s literally a life and death situation,” Akarin said. “My daughter is seriously ill. She needs her mother as a full-time caretaker to take her to the doctor.”
Perez has been charged with misdemeanor for shoplifting for 20 years. Akarin said he stole the food.
“Obviously, this person is not a national security risk or a danger to society,” Akarin said. “In Criminal Court, this is equivalent to a speeding ticket.”
Akarin says she paid the fine and compensation, and the incident was shut down several years ago.
Another hearing in the incident is scheduled for March 20th.
