US Court of Appeal Judge: “The Nazis received better treatment than the Venezuelans removed by Trump”

A US Court of Appeals judge said Monday that he received better treatment than Venezuelan citizens deported to El Salvador by the Trump administration during a hearing last weekend when President Donald Trump used 18th-century wartime authority to remove certain foreigners from US soil.

Before and after, comes when the U.S. DC Circuit Court of Appeals hears debate from the Trump administration on an emergency appeal of a lower court decision.

During Monday’s hearing, Judge Patricia Millett’s Deputy Attorney General Grill sent at least 261 migrants to El Salvador, including more than 100 Venezuelan citizens who were removed solely on the basis of the law temporarily blocked by the court.

“The point here was that there was a plane road of people,” Millett told him. “There was no procedure to notify people.”

“The Nazis received better treatment under the alien enemy law than what happened here,” she said.

Millett signed whether individuals who were deported under the law had time to seek relief as gang members in the form of habeas and challenge their positions before they were deported.

Ensign said he opposed the claim that the Nazis received better treatment, but the government’s position was not immediately clear.

Congress passed the Alien Enemy Immigration Act in 1798, but has since been used only a few times in US history, recently during World War II.

Salvador police officers sued members of Venezuelan gang Tren de Lagua, who had been recently deported by the US government to be jailed at the terrorism confinement center in Tecolca, El Salvador, on March 16, 2025.

It was not immediately clear that the Court of Appeal was planning to issue the judgment.
