A federal judge in Massachusetts accused Trump officials Monday night for failing to comply with his court orders after a group of immigrants were deported from the United States to South Sudan.
In a scathing order on page 17, US District Judge Brian Murphy rejected Trump’s request to amend or retract the judge’s previous decision calling for the detention of six migrants deported to South Sudan without due process or notice.
On Wednesday, Murphy ordered military bases in Djibouti to maintain US custody until each migrant can provide “rational horror interviews.”
As of Monday night, none of these interviews had been conducted, he said.

“Setting an immigration lawsuit on another continent proved to be more difficult and logistically cumbersome than the accused expected,” Murphy said at his order.
He also targeted Trump officials to attack the court. On Monday night, the defendants here said they “erroneously made the court’s order fair” while also producing the very confusion they condemn.”
Salvo is primarily on class action lawsuits from immigrants who are trying to deport them to third countries, including South Sudan, El Salvador and other countries, including Costa Rica and Guatemala, and the administration reportedly turned to the ongoing wave of deportation.
Considering removal of the Third Country, Murphy stressed that he tried to strike a delicate balance between due-process protection under the US Constitution and the Trump administration’s wave of 11-hour rescue and deportation.
Murphy pointed out that the Trump administration has allowed six deported migrants in South Sudan to be held in custody of US officials as long as they conduct what is known as “rational fear interviews” and decide whether immigration concerns are appropriate.

“The court never said that the defendant must convert foreign military bases to immigration facilities,” Murphy wrote on orders Monday night. “It again left it as an option at the defendant’s request.”
Murphy also doubled his previous order as “wise and conservative.” He noted that he repeatedly tried to balance the Trump administration’s demands to remain in South Sudan against the procedures of customs under the US Constitution and legitimate processes.
He also cited the seemingly fluid position of DOJ. He said that Justice Department lawyers previously told the court that they believe 24 hours is a sufficient and meaningful notice to eliminate certain immigrants.
Also, these individuals do not appear to have access to lawyers. In one case, the plaintiffs said that immigrants and customs enforcement officers cancelled at least one pre-Zedur meeting with lawyers and her clients.
“Similarly, members of the class had no chance to learn anything about South Sudan, where the US recently told citizens not to travel due to crime, temptations or armed conflict,” Murphy said.

The US judges have repeatedly ruled that the Trump administration violated legitimate procedures by notifying immigrants of immigrants of immigrants, or this is a view that has been repeated four times by separate Supreme Courts since Trump took office.
The judge has repeatedly ordered the Trump administration to promote his previous return to the United States, but the Trump administration has not publicly complied with requests to return deported individuals.
Meanwhile, White House officials have repeatedly rejected the notion that illegal immigrants are not eligible for legitimate procedures, accusing so-called “activist” judges of trying to establish a political agenda.

Previously he described Murphy as another “activist judge” who said he was trying to protect “criminal illegal immigrant monsters.”
“The court recognizes that the problematic class members here have a criminal history,” Murphy wrote in an obvious response to those comments Monday night.
“But that doesn’t change the legitimate process,” he wrote. “The court will treat its obligations to these principles with the severity that anyone who has committed to the rule of law should understand.”
Murphy added in his order that he welcomes the Trump administration to bring that argument to court in writing.
However, he said, “It is difficult to reach a conclusion from this course of action other than inviting the defendant to lack clarity as a means of avoidance.”
