A federal judge on Wednesday blocked President Donald Trump’s executive order that determined the order exceeded the president’s executive authority, preventing cross-border immigrants from seeking asylum or applying for withholding tax for removal in the United States.
Obama’s appointee, U.S. District Judge Randolph Daniel Moss, said Wednesday that the order exceeds Trump’s authority to suspend legal protections to illegally cross U.S. borders, emphasizing the Immigration and Nationality Act, the Constitution and the Constitution, and endorsing comprehensive rules and procedures that call for “eliminate comprehensive rules and procedures” and standard rules.
“The court recognizes that administrative agencies face major challenges in preventing and detering illegal entry into the United States and arguing for an overwhelming backlog of asylum claims for those who have entered the country,” Moss said in an order.
“However, the INA, by its terms, provides the sole exclusive means of exclusion of people already in the country, and as the Department of Justice correctly concluded nine months ago, neither §1182(f) nor §1185(a) provide the President with unilateral authority to restrict the rights of foreigners existing in the United States.”
The decision was blown up by Trump’s advisor Stephen Miller. Stephen Miller described Moss as a “Marxist” judge in his X post.

“In order to avoid the Supreme Court’s decision on a national injunction, Marxist judges have declared that all potential future illegal foreigners in foreign soils (e.g., most of Planet Earth) are part of a protected global ‘class’ entitled entry to the United States,” Miller said.
