The Lyle and Eric Menendez saga are set to enter a new chapter on Friday as the Los Angeles County District Attorney’s Office is expected to ask the judge to allow the retraction of ententenging recommendations to siblings serving an endless sentence for murdering their parents.
The hearing is the latest in a series of events that could lead to the release of the brothers after serving more than 30 years in prison for the murder of his parents’ shotgun at the family’s Beverly Hills Mansion in 1989.
What to expect from Friday’s hearing
The petition hearing is scheduled for 10am on Friday at Van Nuis Court before Judge Michael Jessick.
District Attorney Nathan Hochman’s office argues that the brothers do not want responsive because they do not fully recognize, recognize, or accept the full responsibility for their criminal conduct.
“That has not been done so far by the Menendez brothers,” the DA’s office wrote in a motion filed on April 4th.
It is also expected that prosecutors will argue that the initial resentenceding recommendation request submitted by his predecessor, George Gascon, is lacking in merit, as Hochman is based on an incomplete review of the case.
Gascon released its res tinsing recommendation in October 2024, a month before his defeat to Hochman in the November election.

The main focus of the hearing is to address whether the DA’s office has the right to withdraw the allegations of resentment, so it is unlikely that they will attend a petition hearing from the San Diego prison or via video links.

Other hearings in April
The responsibility or amended hearing is scheduled for April 17th and 18th, and judges are expected to hear debate about their brothers’ suitability to res timmensing under California law that allows courts to reduce penalties based on a variety of factors, including the age of prisoners and the conduct they are incarcerated.
Despite Hochman’s opposition, it is up to the judge to decide whether the DA will allow the motion of resentment to be withdrawn, and if the court rejects a request for DA’s withdrawal, the judge will decide whether to resemble the brothers.
More High Stakes Reviews by the Parole Board
Governor Gavin Newsom, simultaneously with the responsive process, but at the same time separate, directed the state’s parole board to assess whether Erik and Lyle Menendez, part of an independent risk assessment to be completed by June 13, pose a risk to society.
The assessment is done by a group of correctional experts and psychologists to determine whether the sibling is suitable for parole release.
The report will be shared with JESIC JESIC in case the court proceeds to resent and the brother is eligible for parole.
Newsom’s said his office will conduct its own analysis to determine whether the Menendez brothers deserve tolerance.
