Iowa Attorney General Brenna Bird is appealing that major law enforcement agencies will “make every effort to block, interfere and suspend, and repay the entire county after vowing to deportation operations based on ice detainees they call unconstitutional.”
This lies in the Trump administration’s coordinated, government-wide approach to cracking down on illegal immigration and immigration crimes in the United States.
Bird, a Republican, argues that the self-proclaimed “long-standing” stance of the sheriff’s suspension of immigration enforcement operations based on detainees “has violated Iowa law and prevented cooperation with federal immigration authorities.”
Detainees are formal requests from ICE to other law enforcement agencies, and there is good reason to believe that agents to retain individuals are illegal aliens who pose a threat to the well-being and safety of their communities.
By refusing to respect detainees, ICE officials say law enforcement has put the community at risk by bringing potentially dangerous illegal actors back on the streets.

Nevertheless, Winnesiek County Sheriff Dan Marx promised not to cooperate with ICE detainees in a February 4 Facebook post.
In a now-deleted post, Marx encouraged people to contact his office if they encounter a “federal agent,” and said that he and his staff “need to always be willing to assist in verifying your credentials, and that federal agents should ensure that your rights are not abused” is necessary.
“If the Fed’s actions and documents are within the scope of constitutional parameters (such as an appropriate and valid judicial warrant/court order), they are required to assist as needed or to ensure that their actions are carried out professionally and in the most intrusive way as much as possible,” he said.
“If their actions or documents were not within the scope of constitutional parameters, he continued.

Any actions the sheriff argued were not within the scope of constitutional parameters, which he claimed was “an unconstitutional *request* from ice or three other letters federal agencies.”
Marx argued that “the only reason detainees are issued is because the federal agency lacks sufficient information or it is not taking the time to obtain a valid judicial warrant.”
“Simply put, they are detaining the right person and I’m not sure they’ll need more time to understand,” he argued, adding that “these detainees are a violation of the fourth amendment protections on their warrantless search, seizure, arrest and Sixth Amendment rights.”
Marx concluded his lengthy post by stating that “a long-standing attitude towards not recognizing detainees” and involvement in immigration enforcement is based on “constitutional standards… not opinions, politics, or feelings.”

In response, the Republican governor of Iowa filed an official complaint with the Attorney General about a sheriff violating state laws requiring law enforcement agencies to work with federal immigration authorities. This prompted an investigation that found that despite his rebellious rhetoric, Marx’s office had adhered to “requests of all ice detainees” since 2018.
The Attorney General last week gave Marx a deadline to amend his statement to comply with state law. When he refused to issue corrections, Byrd launched a lawsuit that would pull all state funds into Winneseyk County until the sheriff agreed to comply with state law regarding cooperation with federal immigration authorities.
Byrd argues that Marx’s post is “full of legal and de facto errors that blocked the implementation of immigration laws.”
The lawsuit filed in Polk County District Court cites section 27A.4 of the Iowa Legal Code. This states that the county is “not eligible to receive state funds if local agencies intentionally violate this chapter.”

Commenting on her case, Byrd said “Sanctuary County is illegal under Iowa law.”
“Sheriff Marx was given the opportunity to retract his statement and follow the law and honor the ice detainees, but he refused to make any sacrifices to his hometown county,” she said. “He had no choice but to put the case to justice to enforce our laws and ensure cooperation with federal immigration authorities.”

A Winneshiek County Sheriff’s Office representative declined to Fox News Digital’s request for comment, saying the sheriff and the office “cannot provide comments at this time due to pending lawsuits.”
Winniseyk County auditor Benjamin D. Steins cited the same lawsuit and did not reveal how much money the county would lose.
“Iowa is not a sanctuary for illegal immigrants. Anyone who threatens to “block, interfere, or suspend” immigration enforcement, as was the case with this sheriff,” Byrd told Fox News Digital.

She said her office “gives the sheriff the opportunity to correct his state law violations and cooperate in immigration enforcement, but he doesn’t know that there will be any costs in the community in his hometown.

We are far from the border,” she continued. “Thankfully, President Trump has run to the ground to secure borders, crack down on drug trafficking, reduce crime, and as Iowa’s Attorney General, I will continue to fight to ensure our nation works with federal immigration authorities to keep our communities safe.”
