Early on Monday, August 4, 2025, Edward George Berry III, a resident of Yucca Valley, California, was arrested by San Bernardino County Sheriff’s Office deputies on charges of possession of two previous convicted controlled substances.
At about 2:26am, lawmakers met Berry at Yucca Valley Community Park, adjacent to the Yucca Valley Community Center. During the encounter, it was observed that Berry tried to throw away a glass pipe containing white crystalline residues that matched drug-related devices suspected to be methamphetamine.
After his detention for possession of drug paraphernalia, the search revealed a plastic bag containing similar white crystalline material in his pants pocket.
Record checks showed that Berry had two prior convictions for possession of a controlled substance.
Arrested for a $5 million San Fernando Valley Drug Operation
Under the new legal framework passed by California voters on November 5, 2024 and established by Proposal 36, who passed on December 18, 2024, Berry was arrested for possession of two previously convicted controlled substances currently classified as felony.
Proposal 36, entitled “Homelessness, Drug Addiction and Theft Reduction Act,” will reform the law from Proposition 47 and introduce a new code of punishment and safety aimed at addressing an increase in homelessness, drug addiction and theft. The Act also allows agents to apply enhanced judgments and limit the release of citations before appearing in court when appropriate.
This arrest illustrates the application of updated regulations under Proposition 36.
