Customers who purchased Deep River brand potato chips labeled with “non-GMO ingredients” may be eligible for a cash payout in a class action lawsuit settlement.

Old Lime Gourmet, the company behind Deep River Snacks, has reached a settlement in a class action lawsuit alleging it misled consumers by displaying a “non-GMO ingredient” graphic on certain bags. Old Lyme Gourmet denies these allegations.

Anyone who purchased a snack with this label in the United States between February 2, 2017 and December 6, 2024 will be eligible for the settlement.

What did the class action lawsuit allege?

According to the Rankins v. Old Lime class action lawsuit, Old Lime Gourmet Co. displayed a “Non-GMO Ingredients” graphic on certain Deep River brand chips, giving consumers the idea that the snacks were certified by a third party. The claim was made that it gave the impression that it had been made. As a Non-GMO project, it does not contain genetically modified ingredients.

Plaintiffs allege that the snacks were not certified by a third party. Old Lyme Gourmet denies these claims, and a court has yet to decide which is correct.

TODAY.com reached out to Old Lyme Gourmet for comment, but did not immediately receive a response.

How to file a claim

Anyone who purchased snacks in the U.S. with the “Non-GMO” graphic between February 2, 2017 and December 6, 2024 must receive a “Timely Effective Ingredient” graphic by July 28, 2025. You can submit a claim form.

To file a claim, please visit the class action website and click “Start a Claim.”

According to the site, people can submit a valid application if:

Valid Claims with Proof of Purchase: When you submit a claim with proof of purchase, you will receive $5.00 for the first product and $0.50 for each additional product. There is no limit to the number of products for which payment may be requested, provided proof of purchase is provided for each product claimed. Valid claims without proof of purchase: If you submit a claim without proof of purchase, you will receive $5.00 for the first product and $0.50 for each additional product up to 10.

Each household can only submit one bill.

Claim forms submitted after the July 28, 2025 deadline will be rejected and all rights to receive class benefits under the settlement will be waived.
